Former deputy Notts Police chief accepts settlement ahead of tribunal

A FORMER deputy chief constable of Notts, who was expected to take the county's police authority and Chief Constable Julia Hodson to an employment tribunal, has accepted a settlement.

Howard Roberts claimed the authority did not renew his contract in December 2009 following pressure from Denis O'Connor, a former Her Majesty's Inspectorate of Constabulary for Notts.

The Post reported last July that authority accounts showed the potential cost of losing the tribunal would have been £325,000, with an initial £75,000 required to meet legal fees.

The police authority has refused to give any details about the settlement reached between the two parties.

A spokeswoman for the authority said: "The matter has been settled by mutual agreement between the parties involved. At this time, there is no further information or statement being issued."

Details of the tribunal emerged during a pre-hearing review last May. The hearing discussed a claim by Mr Roberts that he suffered victimisation based on racial discrimination.

The former senior officer, who is Welsh, alleges that Mr O'Connor held a grudge against him following an incident in 2005 when Mr Roberts reported him to colleagues over an alleged racial comment.

Mr Roberts claimed that in September 2009 Ms Hodson told him she was "being pressured to deal with you" by Mr O'Connor.

The force and authority denied the claims at the time, saying Ms Hodson took a neutral position and had no influence on the authority's decision.

She said Mr O'Connor denied making the comment.

    Alternatively, this is yet another of your unverified made up stories that you seem so adept at telling. Multi million dollar law suit and now all traces of this have been located and expunged from everywhere on the internet, right. You may also want to start quoting lines from the Planet of the Apes as I imagine you thought that's a wildlife documentary.”

    I'm sure it does... but then managers should show some backbone and face down people who they genuine fell are pushing dubious claims. I don't know whether Mr Roberts's claim was a genuine one or not - but they've, if this story is correct, payed him a huge sum of money anyway. Don't let irresponsible and hopeless managers off the hook!”

    This resulted in a multimillion dollar payout by the Syndicate to the women which was used by the couple to flee the State.

    I have not got the details and cannot find it on the pages of Google. Perhaps it was hushed up to try and prevent copycats. The Legal Profession is all-powerful in the States.

    I wonder if that happens in Britain?”

    Let's exclude this particular case for a moment. Any court or tribunal structure can be "abused" by someone with dubious motives - but the best way for that to be exposed is by employers who are sure that they have behaved appropriately to face claimants down at the hearing. If the point that you are making is that senior staff shouldn't be afforded advantages that aren't available to lower paid and graded employees, then I agree. Coming back to this case, many will suspect that the Chief Constable and Police Authority simply don't want any (more) embarrassing headlines?”

    It is not this particular case alone it is just that it seems to be the modus operandi of these officials and it happens on such a regular basis and could appear to be the tried and tested way of boosting one's take home cash on retirement or change of job.

    Fully contrived by both sides and profferred to one and all at certain stages of their careers.”

    “RCD180368 I agree with you, it is the right of any employee to take an employer to tribunal if they think they have been treated unfairly.

    The obvious conclusions that will be drawn from this expensive episode is that neither the Chief Constable nor Mr O'Connor feel that they can stand in front of a tribunal and convince them that there is nothing in Mr Roberts claims.

    This then begs another question, since it would appear that it would be the word of two people against one, what else does Mr Roberts have on them that makes them afraid of washing their linen in public?”

    “rdc180368 i agree with your comments, surely an FOI request should find out how much we shelled out, i wouldnt mind but lessons dont get learned, how many more bigwigs must we pay out for just because a certain someone doesnt get on with them or their face doesnt fit ? it never seems to be about actually being capable of doing the job which is what they are employed for in the first place,there are winners but the only losers are the taxpayers per usual,”

    “@starving... It's Mr Roberts's right to take his case to an employment tribunal and I'm not going to criticise him if he genuinely feels he has been treated unfairly by his employer. The more pertinent question is what action(s) - and by whom - created these circumstances.

    If the Chief Constable and members of the Police Authority believe that they have acted properly, then they should be prepared to face Mr Roberts at a tribunal hearing. The fact that they are willing to settle with him ahead of a hearing will inevitably lead people to draw their own conclusions.”

    It seems that being a Public Servant for some is nothing to do with Serving. It is simply a Scam-around!

    They must spend the day plotting and planning how to maximise their take, swell their salaries and pensions and finally walk off with a payout that most can only dream about . . . It's like having a sure-fire, guaranteed Lottery Win built into your Employment Package!

    So the threat of Tribunal made the Council Pay Out. is that not BLACKMAIL?

    Why can't ordinary citizens get this kind of redress when threatened with The Courts over fines and the dozens of minor non-criminal misdemeanours dreamt up by the so-called Authorities to bring in the Revenue to pay-off these high-class con merchants. Even when they are not up to the job and a complete failure they get what amounts to a Live Savings to normal workers who struggle, sacrifice and save hard all their days.

    IT IS CONTRIVED BLACKMAIL AND MISAPPROPRIATION OF PUBLIC FUNDS. IT IS HAPPENING EVERYWHERE AND THEY ARE ALL IN IT TOGETHER.
