A MAN kicked an acquaintance in the head then hit him with a bottle as he lay unconscious on the floor.

Duncan Chideya, 29, had fought with Abdillahi Mousse after they fell out on New Year's Eve last year.

Chideya also tried to break Mr Mousse's arm, Nottingham Crown Court heard.

A CCTV camera captured the attack and Chideya's attempts to clean up the scene.

The judge who jailed Chideya for two years described the attack as "appalling" and said it was something of a miracle he was not in the dock facing a long prison sentence.

The court heard Chideya, 29, had been to visit his family in Birmingham and had fallen out with his mum and the rest of his family.

The victim visited him the next day and they fell out and a scuffle started.

Richard Posner, mitigating, said Chideya accepted he had drunk too much and completely lost control, adding he had been angry and upset at what had happened that day.

"He cannot believe his behaviour," said Mr Posner. "Fortunately the victim was not seriously injured and he got up and walked away. Chideya was wearing light canvas shoes and was not kicking him with boots."

Chideya, of Ash View, Radford, pleaded guilty to attempting to cause grievous bodily harm with intent and possession of cannabis, found on him when he was arrested.

No separate penalty was given for the cannabis charge.

The court heard Chideya was first convicted at Manchester Crown Court when he was 23 after he robbed a man of a pizza.

"It's clear Duncan Chideya's problems started when he was very young," said Mr Posner.

"Drink has been the root of his offending. His siblings are all successful. He is not."

“If someone kicks someone in the head, it should be attempted murder, not GBH. Until the law changes, these thugs will keep getting away with it.”
