Council rejects street smoking ban
A BAN on smoking on city streets will not be considered by Nottingham City Council because it could breach human rights laws.
Councillors put forward the idea in September to combat the numbers of smokers standing outside buildings.
They recommended Nottingham City Council's director of performance and scrutiny investigate the possibility of a bye-law to control street smoking.
But council officer Julie Rankin has ruled the law - which would apply only to Nottingham - would not be "appropriate".
She said: "A ban on smoking in all streets would be subject to challenge by human rights legislation and may prove difficult to enforce."

“It is time for Nottingham Landlords to do what many others are doing around the country and Ban their local MPs who voted for a total smoking ban and ban local councillors who support the ban in pubs and clubs,name and shame them for backing this ill thought out law.as the Rev JP has said in the EU you still have a free choice.”

“Of course...it all makes sense now.....you go into a pub, light up...get fined, so you then step outside to finish it....get fined, you then stamp out the cigerette and then get fined for littering!
As for the election, originally, the Health Bill 2006 was going to let Pubs and Clubs decide whether they were smoking/non-smoking or have designated areas..in accordance with an arrangement between the Government and the Licensee Trade in 2001...however, by January 2006, less than 5% of all public houses were smoke-free, obviously the government didn't like this....
Of course,they have left themselves a loophole so that the 'national authority' can, at a later date, designate some venues as smoking venues....of course, this will be used in the next General Election as blackmail.
The Smoking Pan in public was to bring Britain in line with the EU...however, only Britain and Eire have a total ban, Germany have decided that ANY ban would be unconstitutional while Yugoslavia seem to have all but refused to consider a ban...the rest of the EU allow bars etc. to designate areas for smokers or to have smoking/non-smoking rooms.”

“Here is some information for the anti smoking brigade.
It a well documented fact the Alcohol abuse costs the Helath System far more than smoking does.
It cost the tax payer far more to treat people with drink related heath problmes and with other problems related to drinking and Alcoholism than it does with illness's due to smoking.

“I would like to say some common sense has been shown,but with the total smoking ban still in force i dont think so,the smoking ban has been a massive disaster not only to Pubs and Clubs but also to the Country with NO health benefits at all,like other Countries smoking rates have gone up since the ban and so as unemployment as a direct result of the ban,you would have to be a fool to call the smoking ban a success in any way,Smokers are Voters and at the next election Labour will be out,it is time for people to have a free choice,smoking and non smoking venues then there would be no need for smokers to stand outside on the paths smoking a legal product.”
